Subletting without permission is a ground for eviction under most state Rent Control Acts and the Model Tenancy Act 2021. If you want to sublet — to a flatmate, on Airbnb, or as a PG — you need a written subletting clause in your rent agreement or a separate written permission letter from the landlord. The original tenant remains fully liable for rent and property damage even if a sub-tenant causes it.

How to get landlord permission to sublet

If you need to take in a flatmate or sublet part of the flat, approach the landlord before doing so. Most landlords in India are open to flatmates if they are the same gender and you give them notice. Get the permission in writing — a WhatsApp message confirming 'I'm okay with you sharing with [name]' is better than nothing, but a formal addendum to the agreement is best.

What happens if you sublet without permission?

The landlord can serve an eviction notice immediately upon discovering unauthorised subletting — this is a ground for eviction in every major Indian state. Even if you are within the lock-in period, subletting without consent allows the landlord to terminate the agreement for breach. The landlord can also claim damages beyond the security deposit. Courts in India consistently rule against tenants who sublet without permission.

Can I take a flatmate in a rented flat in India without asking the landlord?

Technically no — taking in an additional occupant who is not named in the agreement is informal subletting and requires the landlord's consent. In practice, many landlords are fine with flatmates of the same gender if they are informed. Always get written permission, even via WhatsApp, before the flatmate moves in.

Can I list my rented flat on Airbnb in India?

Almost certainly not. Residential rent agreements explicitly prohibit commercial use of the premises, and short-term rental is treated as commercial activity. Most housing society bye-laws also prohibit Airbnb-style rentals. Operating a short-term rental without permission is grounds for eviction and may also violate local municipal regulations.

Can a landlord charge more rent after knowing I have a flatmate?

The landlord cannot unilaterally increase rent — rent is fixed for the agreement term. However, they can refuse to give consent unless you agree to revised terms (higher rent, additional deposit) for the flatmate. This must be mutually agreed and documented in writing.

Who is responsible if a sub-tenant damages the flat?

Does the Model Tenancy Act allow subletting?
