TDS rules for NRI landlords receiving rent in India

Rent agreement for NRI-owned property: what to check

When renting out NRI-owned property, the rent agreement should clearly mention the landlord's address abroad (or a local correspondence address), the PoA holder's details if signing via PoA, and a clause specifying that the tenant will deduct TDS per Section 195 before remitting rent. The agreement must also specify bank transfer as the payment method — cash payments above ₹20,000 per transaction are prohibited under FEMA regulations for NRI accounts.
