HRA Edge Cases: Paying Rent to Parents, Spouse & Form 12BB (2025)
Updated 13 March 2026 | 8 min read
Quick answer
You can claim HRA if you pay rent to parents — but you need a written rent agreement and monthly rent receipts, and the parent must show rental income in their ITR. You cannot claim HRA if you pay rent to your spouse (they are usually co-owner). Form 12BB must be submitted to your employer with rent receipts to claim HRA exemption. If your employer rejects valid digital rent receipts, escalate to the HR compliance team — digital receipts are legally valid under the IT Act.
Can I claim HRA if I pay rent to my parents?
Yes, but with conditions. The Income Tax Department allows HRA claims for rent paid to parents if: (1) you have a registered or stamped rent agreement with your parents, (2) you make actual bank transfers each month (not cash), (3) you collect monthly rent receipts, and (4) your parents declare the rent as income in their ITR under 'Income from House Property'. The property must be owned by your parent(s) — not jointly with you.
- Written rent agreement between you and parent — mandatory
- Bank transfer (not cash) — documents the actual payment
- Monthly rent receipts — signed by parent-landlord
- Parent must declare it as rental income in their ITR
- If annual rent > ₹1 lakh, parent's PAN must be in your Form 12BB
Can I claim HRA if I pay rent to my spouse?
No, in almost all cases. The Income Tax Department does not allow HRA claims for rent paid to a spouse because they are typically considered a co-owner or beneficial owner of the property. Courts have consistently rejected such claims unless the spouse has a completely separate, documented source of funds and the property is solely in their name. If your spouse owns a separate property not jointly held with you, consult a CA for the specific facts.
How to fill Form 12BB for HRA claim
Form 12BB is the statement of claims submitted to your employer for tax deductions including HRA. For HRA, you must provide: (1) Name and address of landlord, (2) Amount of rent paid per month, (3) Landlord's PAN if annual rent exceeds ₹1 lakh. Submit it at the start of the financial year (April) and update if rent changes. Your employer will use this to compute TDS from salary. You can also claim HRA directly in your ITR filing if you forget to submit to employer.
- Form 12BB is submitted to your employer — not to the IT department
- Landlord PAN mandatory if annual rent > ₹1,00,000
- Submit at the start of the financial year (April) or when you join
- If missed, claim HRA directly while filing your ITR
Employer rejected my rent receipts — what to do?
Digital rent receipts generated by tools like ProRently are legally valid under the IT Act, 2000. If your employer's HR or accounts team rejects them, you can: (1) Request a written reason for rejection, (2) Share the legal basis — CBDT has confirmed digital receipts are valid, (3) Escalate to HR compliance or use the receipts while filing your ITR directly. Employers cannot legally reject receipts that meet the format requirements (landlord name, address, amount, period, signature).
HRA exemption not available under the new tax regime
HRA exemption under Section 10(13A) is only available if you file taxes under the old tax regime. If you have opted for the new tax regime (lower flat rates, no deductions), you cannot claim HRA exemption. However, you can switch regimes every year — choose whichever gives you lower tax based on your rent, investments, and income.

Can I claim HRA if paying rent to parents?
Yes. Pay rent via bank transfer, have a written rent agreement, collect monthly receipts, and ensure your parents declare the rent as income in their ITR. Provide their PAN in Form 12BB if annual rent exceeds ₹1 lakh.
Can I pay rent to my spouse and claim HRA?
Generally no. The IT Department does not allow HRA claims for rent paid to a spouse as they are usually treated as co-owners. Very specific exceptions may apply — consult a CA.
What is Form 12BB for HRA?
Form 12BB is a declaration submitted to your employer with details of rent paid, landlord name, address, and PAN (if rent > ₹1L/year). Employers use it to compute your TDS deduction correctly. It is not submitted to the IT Department.
My employer rejected my digital rent receipts. Is that legal?
Digital rent receipts are legally valid under the IT Act, 2000. Your employer cannot legally reject properly formatted digital receipts. If rejected, request a written reason and escalate. Alternatively, claim HRA in your ITR directly.
Is HRA available under the new tax regime?
No. HRA exemption under Section 10(13A) is only available under the old tax regime. If you have opted for the new tax regime, HRA is not deductible.
